for accommodation contracts with Venediger Lodge Management GmbH

These General Terms and Conditions (hereinafter the “Terms”) govern the contractual relationship between Venediger Lodge Management GmbH, Marktstraße 64, 5741 Neukirchen, Austria (hereinafter “Venediger Lodge” or the “Accommodation Provider”), and its guests or contracting parties.
In addition to these Terms, the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) of the Austrian Hoteliers Association apply, insofar as these Terms do not provide otherwise. In the event of any conflict, the provisions of these Terms shall prevail.
§ 1 Scope of Application and Contracting Parties
1.1 These Terms apply to all accommodation agreements between Venediger Lodge and its guests or contracting parties, regardless of the booking channel (direct, by telephone, by e-mail, or via a booking platform).
1.2 Any deviating terms and conditions of the contracting party shall not apply unless Venediger Lodge expressly agrees to their validity in writing.
1.3 Venediger Lodge Management GmbH and Schweinberger Gastronomie GmbH are separate legal entities sharing the same premises at Marktstraße 64, 5741 Neukirchen. These Terms govern exclusively the accommodation agreement with Venediger Lodge Management GmbH; Schweinberger Gastronomie GmbH is solely responsible and liable for any food and beverage services.
§ 2 Definitions
2.1 “Accommodation Provider”: Venediger Lodge Management GmbH.
2.2 “Contracting Party”: the person who enters into the accommodation agreement.
2.3 “Guest”: the person who actually makes use of the accommodation service. The Contracting Party and the Guest may be one and the same person.
§ 3 Conclusion of Contract, Deposit
3.1 The accommodation agreement is concluded upon booking confirmation by Venediger Lodge and payment of the agreed deposit. The booking is only deemed binding once the deposit has been received.
3.2 Venediger Lodge is entitled to request a deposit or the details of a valid credit card as security. The relevant details will be communicated to the Contracting Party prior to conclusion of the agreement.
3.3 Any costs of payment transactions (e.g. bank transfer fees) shall be borne by the Contracting Party.
§ 4 Check-in and Check-out
4.1 Apartments/rooms are available from 3:00 p.m. on the agreed arrival date. Guests arriving after 7:00 p.m. are kindly requested to notify us in advance.
4.2 Reception is staffed daily from 8:00 a.m. to 8:00 p.m. For later arrivals, and by prior arrangement (e-mail, telephone or messenger), the key can be left in the key safe at the garage.
4.3 On the day of departure, the apartment/room must be vacated by 11:00 a.m. at the latest. Should this deadline not be observed, Venediger Lodge is entitled to charge for an additional day.
§ 5 Cancellation of the Accommodation Agreement by the Contracting Party – Cancellation Terms
5.1 The Contracting Party may cancel the accommodation agreement up to 7 days before the agreed arrival date without giving reasons and free of charge (cancellation fee 0%).
5.2 If the cancellation is made within 7 days of the agreed arrival date, or if the Guest fails to arrive (no-show), the full booked amount becomes payable as a cancellation fee (100%).
5.3 The reference time for the start of accommodation (check-in) is 6:00 p.m. on the agreed arrival date. Cancellation and no-show fees, as well as charges for rooms/apartments not used, are always calculated on the basis of the full booked amount.
5.4 In the event of early departure or partial use of the booked period, there is no entitlement to a refund unless expressly agreed otherwise. Depending on the booking situation, Venediger Lodge is happy to find a fair, mutually agreeable solution.
5.5 Deviating cancellation terms may apply to certain offers (e.g. promotional, early-bird, or non-refundable rates), which will be disclosed to the Contracting Party at the time of booking and shall take precedence over these provisions.
5.6 As cancellation fees may apply depending on the timing of the cancellation, Venediger Lodge recommends taking out travel cancellation insurance – particularly in view of potential short-notice reasons for cancellation, such as illness or unavoidable commitments.
5.7 If the Contracting Party is unable to arrive at the establishment on the arrival date because unforeseeable, extraordinary circumstances (e.g. extreme snowfall, flooding, official travel restrictions) rule out any possibility of arrival, the obligation to pay for the days affected shall not apply. Should arrival become possible again within three days, the payment obligation shall resume from that point onward.
§ 6 Cancellation by Venediger Lodge
6.1 If a deposit has been agreed and is not paid on time, Venediger Lodge is entitled to withdraw from the agreement without granting a grace period.
6.2 If the Guest has not arrived by 7:00 p.m. on the agreed arrival date and no later arrival has been notified, Venediger Lodge is under no obligation to provide accommodation for that day.
6.3 For objectively justified reasons, Venediger Lodge may terminate the agreement by unilateral declaration up to 2 months before the agreed arrival date at the latest.
§ 7 Non-Smoking Policy
7.1 Venediger Lodge operates exclusively as a non-smoking establishment; all rooms and apartments are non-smoking. Smoking is permitted only in outdoor areas.
7.2 In the event of non-compliance, Venediger Lodge is entitled to charge for any resulting cleaning and odour-removal costs.
§ 8 Liability
8.1 Venediger Lodge’s liability for property brought in by the Contracting Party or Guest is governed by Sections 11 and 12 of the AGBH 2006.
8.2 Where the Contracting Party is a business (“Unternehmer”) within the meaning of the Austrian Consumer Protection Act, Venediger Lodge’s liability for damage caused by slight or gross negligence is excluded; consequential loss, loss of profit, and purely financial loss shall not be reimbursed. Statutory liability towards consumers remains unaffected.
8.3 Supervision of Children: Throughout the stay, the duty of supervision over minor guests rests exclusively with their parents/legal guardians or accompanying persons. This applies in particular to the use of leisure facilities, outdoor areas, ski and bike rooms, as well as all pathways and traffic areas at Venediger Lodge. Venediger Lodge staff do not assume any duty of supervision unless expressly agreed in writing.
8.4 Theft in Apartments and Rooms: Venediger Lodge is liable for the loss of, or damage to, valuables, cash, jewellery, and other personal belongings brought into the apartment or room by the Guest only in the case of gross negligence on the part of its staff. Guests are advised to keep valuables in the apartment’s own safe and to keep the room/apartment locked at all times when unattended. Any theft must be reported to reception and to the police without delay; otherwise, claims for compensation are excluded.
8.5 Theft by Third Parties: Venediger Lodge is not liable for damage suffered by the Guest as a result of unlawful conduct by third parties – in particular theft, damage to property, or unauthorised entry into the premises by persons not attributable to Venediger Lodge – unless Venediger Lodge is guilty of gross organisational negligence.
8.6 Ski Room and Bike Room: The ski, bike, and equipment rooms at Venediger Lodge are provided to guests for storing their sports equipment but do not constitute a supervised or secured storage facility within the meaning of cloakroom liability. Venediger Lodge is liable for the loss of, or damage to, items stored there – in particular through theft – only in the case of gross negligence on the part of its staff. Guests are advised to additionally lock or secure high-value equipment (e.g. e-bikes, ski boots) themselves.
8.7 Theft of Kitchen Utensils and Venediger Lodge Property: Venediger Lodge’s inventory – in particular kitchen utensils, crockery, bed linen, and other furnishings within the apartments – must be used exclusively on the premises and must not be removed. In the event of loss, damage, or unauthorised removal of Venediger Lodge property, the Contracting Party shall be liable for the full cost of the resulting damage. Venediger Lodge reserves the right to report the matter to the police in justified cases of suspicion.
§ 9 Obligations of the Contracting Party, Set-Off
9.1 The Contracting Party is obliged to settle the agreed remuneration, plus any additional services used, by the time of departure at the latest.
9.2 The Contracting Party may not set off its own claims against claims of Venediger Lodge, unless such claims have been judicially established or acknowledged by Venediger Lodge.
§ 10 Early Termination of the Agreement
10.1 Venediger Lodge is entitled to terminate the accommodation agreement with immediate effect for good cause, in particular pursuant to Section 15 of the AGBH 2006 (e.g. significantly detrimental or improper use, or default in payment despite a grace period having been set).
§ 11 Data Protection
11.1 The processing of personal data is carried out in accordance with Venediger Lodge’s Privacy Policy, available at [www.venediger-lodge.at/privacy-policy](https://www.venediger-lodge.at/privacy-policy).
§ 12 Final Provisions
12.1 These Terms are governed by Austrian law, to the exclusion of its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
12.2 The place of performance is the registered seat of Venediger Lodge in 5741 Neukirchen.
12.3 For disputes with businesses, the competent court at the seat of Venediger Lodge shall have exclusive jurisdiction. For consumers resident in Austria, as well as for consumers resident in another EU Member State, Iceland, Norway, or Switzerland, the jurisdiction provisions of Sections 17.4 and 17.5 of the AGBH 2006 shall apply.
12.4 Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory rule that most closely reflects its economic purpose.
12.5 In all matters not expressly regulated herein, the provisions of the AGBH 2006 of the Austrian Hoteliers Association shall apply in addition.
