Terms and Conditions (T&Cs)

These General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between Venediger Lodge Management GmbH, Marktstraße 64, 5741 Neukirchen, Austria (hereinafter “Venediger Lodge” or “the Accommodation Provider”), and its guests and contracting parties.

In addition to these GTC, the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) of the Austrian Hotel Association (Österreichische Hoteliervereinigung) apply, insofar as these GTC do not provide otherwise. In the event of any conflict, the provisions of these GTC shall prevail.

This English version is provided for information purposes. In the event of any discrepancy between the German and the English version, the German version shall prevail.

§ 1 Scope and Contracting Parties

1.1 These GTC apply to all accommodation contracts between Venediger Lodge and its guests or contracting parties, regardless of the booking channel (direct, by telephone, by email or via a booking platform).

1.2 Any differing terms and conditions of the Contracting Party shall not apply unless Venediger Lodge expressly agrees to their validity in writing.

1.3 Venediger Lodge Management GmbH and Schweinberger Gastronomie GmbH are separate legal entities sharing the same registered address at Marktstraße 64, 5741 Neukirchen. These GTC govern exclusively the accommodation contract with Venediger Lodge Management GmbH; Schweinberger Gastronomie GmbH is solely responsible and liable for all food and beverage services.

§ 2 Definitions

2.1 “Accommodation Provider”: Venediger Lodge Management GmbH.

2.2 “Contracting Party”: the person who concludes the accommodation contract.

2.3 “Guest”: the person who actually uses the accommodation services. The Contracting Party and the Guest may be the same person.

§ 3 Conclusion of Contract, Deposit

3.1 The accommodation contract is concluded upon booking confirmation by Venediger Lodge and payment of the agreed deposit. The booking only becomes binding once the deposit has been received.

3.2 Venediger Lodge is entitled to request a deposit or the details of a valid credit card as security. The details will be communicated to the Contracting Party before the contract is concluded.

3.3 Payment transaction costs (e.g. bank transfer charges) shall be borne by the Contracting Party.

§ 4 Check-in and Check-out

4.1 Apartments/rooms are available from 15:00 on the agreed day of arrival. Guests arriving after 19:00 are kindly asked to give brief notice in advance.

4.2 Reception is staffed daily from 08:00 to 20:00. For later arrivals, the key can be left in the key safe by the garage by prior arrangement (email, telephone or messenger).

4.3 On the day of departure, the apartment/room must be vacated by 11:00 at the latest. If this deadline is not met, Venediger Lodge is entitled to charge for an additional day.

§ 5 Cancellation by the Contracting Party: Cancellation Policy

5.1 Cancellation terms depend on the time of travel. A distinction is made between high season and low season. In low season, the Contracting Party may withdraw from the accommodation contract free of charge and without giving reasons up to 7 days before the agreed day of arrival; in high season, up to 14 days before the agreed day of arrival (cancellation fee 0%). The applicable period will be communicated to the Contracting Party at the time of booking.

5.2 If the cancellation is made within this period before the agreed day of arrival, or if the Guest fails to arrive (no-show), the full booked amount is payable as a cancellation fee (100%).

5.3 The reference time for the start of the stay (check-in) is 18:00 on the agreed day of arrival. Cancellation and no-show fees, as well as charges for rooms/apartments not used, are always calculated on the basis of the full booked amount.

5.4 In the event of early departure or if the booked period is not used in full, there is no entitlement to a refund unless expressly agreed otherwise. Depending on occupancy, Venediger Lodge will gladly seek a fair, mutually agreeable solution.

5.5 Individual offers (e.g. promotional, early booking or non-refundable rates) may be subject to differing cancellation terms communicated to the Contracting Party at the time of booking, which take precedence over these provisions.

5.6 As cancellation fees may apply depending on timing, Venediger Lodge recommends taking out travel cancellation insurance, particularly in view of reasons that may arise at short notice, such as illness or unavoidable commitments.

5.7 If the Contracting Party is unable to reach the accommodation on the day of arrival because unforeseeable, extraordinary circumstances (e.g. extreme snowfall, flooding, official travel restrictions) make any means of arrival impossible, the obligation to pay is waived for the days affected. If arrival becomes possible again within three days, the obligation to pay is reinstated from that point onwards.

§ 6 Cancellation by Venediger Lodge

6.1 If a deposit has been agreed and is not paid on time, Venediger Lodge is entitled to withdraw from the contract without granting a grace period.

6.2 If the Guest has not arrived by 19:00 on the agreed day of arrival and no later arrival has been notified, Venediger Lodge is under no obligation to provide accommodation for that day.

6.3 For objectively justified reasons, Venediger Lodge may terminate the contract by unilateral declaration no later than 2 months before the agreed day of arrival.

§ 7 Non-Smoking Property

7.1 Venediger Lodge is operated exclusively as a non-smoking property; all rooms and apartments are non-smoking. Smoking is permitted outdoors only.

7.2 In the event of a breach, Venediger Lodge is entitled to charge for the resulting cleaning and odour removal costs.

§ 8 Liability

8.1 The liability of Venediger Lodge for property brought onto the premises by the Contracting Party or Guest is governed by §§ 11 and 12 AGBH 2006.

8.2 If the Contracting Party is a business within the meaning of the Austrian Consumer Protection Act (KSchG), the liability of Venediger Lodge for damage caused by slight or gross negligence is excluded; consequential damage, loss of profit and pure financial loss shall not be compensated. Statutory liability towards consumers remains unaffected.

8.3 Supervision of children: Responsibility for supervising minor guests lies solely with their parents or legal guardians, or with the accompanying adults, throughout the entire stay. This applies in particular to the use of leisure facilities, outdoor areas, ski and bike rooms, and all paths and traffic areas of Venediger Lodge. Staff of Venediger Lodge do not assume any supervisory duties unless this has been expressly agreed in writing.

8.4 Theft in apartments and rooms: For the loss of or damage to valuables, cash, jewellery and other personal belongings that the Guest brings into the apartment or room, Venediger Lodge is only liable in the event of gross fault on the part of its staff. Guests are advised to keep valuables in the in-room safe and to always lock the room or apartment when absent. Any theft must be reported immediately to reception and to the police; otherwise, claims for compensation are excluded.

8.5 Theft by third parties: Venediger Lodge is not liable for damage suffered by the Guest as a result of unlawful conduct by third parties (in particular theft, damage to property or unauthorised entry into premises by persons not attributable to Venediger Lodge), unless Venediger Lodge is guilty of gross organisational fault.

8.6 Ski room and bike room: The ski, bike and equipment rooms of Venediger Lodge are available to guests for storing their sports equipment, but are not deemed supervised or locked storage facilities giving rise to cloakroom liability. For the loss of or damage to items stored there, in particular through theft, Venediger Lodge is only liable in the event of gross fault on the part of its staff. Guests are advised to additionally lock or secure high-value equipment (e.g. e-bikes, ski boots) themselves.

8.7 Theft of kitchen utensils and property of Venediger Lodge: The inventory of Venediger Lodge, in particular kitchen utensils, crockery, bed linen and other apartment furnishings, may only be used on the premises and must not be removed. In the event of loss, damage or unauthorised removal of property of Venediger Lodge, the Contracting Party is obliged to compensate the damage in full. Venediger Lodge reserves the right to report the matter to the police in justified cases of suspicion.

§ 9 Obligations of the Contracting Party, Set-off

9.1 The Contracting Party is obliged to pay the agreed price, plus any additional services used, at the latest upon departure.

9.2 The Contracting Party may not set off its own claims against claims of Venediger Lodge unless the claim has been established by a court or acknowledged by Venediger Lodge.

§ 10 Early Termination

10.1 Venediger Lodge is entitled to terminate the accommodation contract with immediate effect for good cause, in particular in accordance with § 15 AGBH 2006 (e.g. significantly detrimental or improper use, default in payment despite a grace period having been set).

§ 11 Data Protection

11.1 Personal data is processed in accordance with the privacy policy of Venediger Lodge, available at www.venediger-lodge.at/privacy-policy.

§ 12 Final Provisions

12.1 Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 The place of performance is the registered office of Venediger Lodge in 5741 Neukirchen.

12.3 For disputes with businesses, the court with subject-matter jurisdiction at the registered office of Venediger Lodge shall have exclusive jurisdiction. For consumers resident in Austria, and for consumers resident in another EU member state, Iceland, Norway or Switzerland, the jurisdiction provisions of §§ 17.4 and 17.5 AGBH 2006 apply.

12.4 Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision that comes closest to its economic purpose.

12.5 In all matters not expressly regulated herein, the provisions of the AGBH 2006 of the Austrian Hotel Association apply in addition.
